These terms and conditions apply to the Vo2Max Calculator app (hereby referred to as Application) for mobile devices that was created by Fitame (hereby referred to as Service Provider) as an Ad Supported service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.
In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.
To use certain features of the Application, you may be required to create an account. By creating an account, you agree to provide accurate, complete, and current information about yourself as prompted by the registration process. You are responsible for maintaining the confidentiality of your account credentials (such as your username and password) and for all activities under your account.
You will be able to log in to the Application using your account credentials. You agree to maintain the security of your login information and immediately notify the Service Provider if you believe your account has been compromised. The Service Provider is not responsible for any unauthorized access to your account.
By creating an account, you agree that the Service Provider will store and process the personal information provided during registration, including but not limited to your name, email address, and other details relevant to your account. This information will be used to authenticate your account, provide you with access to the Application, and improve your user experience.
The Service Provider reserves the right to suspend or terminate your account at any time if you violate these terms. You may also request to terminate your account by contacting the Service Provider at the provided support email.
The Application may offer third-party authentication services (such as Google or Facebook login). If you use such services, please review their respective privacy policies and terms of use. The Service Provider is not responsible for any issues related to third-party authentication services.
The Service Provider reserves the right to suspend or terminate your account at any time for any reason, including but not limited to violations of these Terms and Conditions. You may also request to terminate your account by contacting the Service Provider at the provided support email. Upon account termination, your access to the Application will be revoked, and any data associated with your account may be deleted, in accordance with applicable laws and our Privacy Policy.
If the Service Provider believes you have violated these Terms and Conditions or engaged in activities that could harm the Application or its users, your account may be temporarily suspended. During this suspension, you will not be able to access your account or any associated features of the Application. You will be notified of the suspension, and you may appeal the suspension by contacting the Service Provider.
If you repeatedly violate the Terms and Conditions or engage in conduct that the Service Provider deems harmful, your account may be permanently terminated. Upon termination, all your account data, including any personal information and user-generated content, may be deleted. The Service Provider will make reasonable efforts to inform you of the termination and its consequences before proceeding with this action.
You may request the termination of your account at any time by contacting the Service Provider through the provided support email. Once your account is terminated, your access to the Application will be revoked, and your personal data may be deleted, subject to the applicable legal obligations for data retention.
After account termination, whether by the Service Provider or at your request, you will lose access to any data, features, or content associated with your account. Any purchases, subscriptions, or in-app content may also be forfeited, depending on the terms of the relevant service. The Service Provider will not be liable for any loss of data or content following account termination.
Following the termination of your account, the Service Provider may retain certain personal data for legal, regulatory, or business purposes, as outlined in the Privacy Policy. This data will not be used for any other purposes without your consent.

You understand that VO2 max values are influenced by various factors, including age, physical condition, and individual fitness level. You are solely responsible for assessing your fitness and consulting a healthcare professional as needed. The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device.

Cancellation and Refund
You have the right to cancel your subscription within 7 calendar days from the date of purchase or activation of the service, even if the service has been used. In this case, you are entitled to a full refund, and no justification is required.
After this 7 day period, no partial or prorated refunds will be issued for early cancellation, regardless of the subscription plan (monthly, quarterly, or annual).

Free Trial Period
When subscribing to the annual plan, you are entitled to 7 days of free trial before any payment is processed. If you cancel the subscription within the free trial period, no charges will be made.
⚠️Each user is eligible for only one free trial, regardless of the number of devices, accounts, or payment methods used.
⚠️ Cancellation must be done through the app or the platform used to manage your subscription, before the trial ends or before renewal.
Auto-Renewal
All subscriptions renew automatically at the end of thebilling period.
To avoid being charged for the next period, you must cancel at least 24 hours in advance.
